Terms of Service

These Terms of Service ("Terms") govern your use of Cruisin, a mobile web app for coordinating group drives ("cruises"). Cruisin is operated by [Patrick Vohs / Cruisin] [(ABN [____])]. By creating an account or using Cruisin, you agree to these Terms. If you don't agree, don't use the app.

1. Who can use Cruisin

You must be at least 16 years old to use Cruisin. By using the app you confirm you meet this requirement and that the information you give us is accurate. If you use Cruisin while driving, you must hold any licence or permit required by law for the vehicle you are operating.

2. Your account

Accounts and sign-in are handled by our authentication provider, Clerk. You're responsible for keeping your login secure and for all activity that happens under your account. Tell us promptly if you believe your account has been accessed without your permission. You can delete your account at any time from the "You" tab — see our Privacy Policy for what this removes.

3. Safety and lawful driving — read this

Cruisin is a coordination tool, not a driving aid. You are solely responsible for how you drive. In particular:

  • Never interact with the app while driving in a way that distracts you or breaches road rules. Set up your cruise before you move, and have a passenger handle the phone while underway.
  • Obey all road rules and laws at all times — speed limits, signals, lane rules, and licensing requirements. Following a planned route or another driver never overrides the law or your own judgement.
  • Don't use Cruisin to organise or take part in illegal activity, including street racing, "burnouts" or hooning, street takeovers, convoys that obstruct traffic, or any conduct that endangers people or property.
  • Location, distance, route and timing information can be delayed, inaccurate, or wrong. Don't rely on it for safety-critical decisions.

You drive at your own risk and are responsible for your own conduct and for any consequences of your driving.

4. Acceptable use

You agree not to:

  • use Cruisin for any unlawful purpose or to coordinate unlawful activity;
  • harass, threaten, impersonate, or share the location of others without their involvement in the same cruise;
  • upload content that is illegal, abusive, infringing, or misleading (including profile names and photos);
  • attempt to disrupt, overload, reverse-engineer, scrape, or gain unauthorised access to the service or its data;
  • use the app on behalf of anyone who is barred from using it.

We may suspend or terminate access for conduct that breaches these Terms or that we reasonably consider harmful.

5. Live location sharing

When you join a cruise and your cruise is active, your live location is shared with the other members of that cruise so everyone can see each other on the map. By using this feature you consent to that sharing. You can stop sharing at any time by leaving the cruise or revoking location permission in your device settings.

6. Your content

You keep ownership of the content you provide (such as cruise names, your display name, and your profile photo). You grant us a limited licence to host and display that content as needed to operate the service. You're responsible for the content you provide and confirm you have the right to use it.

7. Third-party services

Cruisin relies on third-party services to function — including Clerk (accounts), Mapbox (maps, routing and search), and our hosting and infrastructure providers. Your use of features powered by these services may also be subject to their terms. We're not responsible for third-party services we don't control.

8. Availability and "as is"

Cruisin is provided on an "as is" and "as available" basis. We don't guarantee the service will be uninterrupted, error-free, or that location and timing data will be accurate or timely. We may change, suspend, or discontinue features at any time.

9. Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded. Where it can be excluded, to the maximum extent permitted by law we are not liable for any indirect, incidental, or consequential loss, or for loss arising from your driving, your conduct, the conduct of other users, or your reliance on location, route, or timing information. Where our liability cannot be excluded but can be limited, it is limited (at our option) to re-supplying the service or paying the cost of having it re-supplied.

10. Suspension and termination

You can stop using Cruisin and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the app in a way that risks harm to others or to the service.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes we'll take reasonable steps to let you know. Continuing to use Cruisin after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
